It was not the fact that, during his trial and incarceration, Jonas Oldacre’s creditors depleted most of his assets. Nor that his several inventive ways of exacting revenge on Mr Sherlock Holmes had failed. Paralysed by his third apoplectic seizure in Princetown’s infirmary, Oldacre writhed in his own personal hell because he never had the opportunity to change his will.

That truly is brilliant thinking - that's surely what must have happened. For Oldacre's plot to work, his will has to be perfectly legal and McFarlane has to be his heir. And then Oldacre's arrested, and presumably carted off to prison, and there's no time to sort out his legal position.
